TORONTO - Ontario Ombudsman Andre Marin's annual report reveals the quirky, maddening, irrational and just plain nasty things that can occasionally happen to people when they interact with government.

For instance, a woman who paid $200 a month to Legal Aid services for a family lawyer felt he did not do a good job of representing her. The lawyer agreed and wrote that she should get her money back, but it was sent to her ex-husband instead.

The implications were huge for both Tipple and Rotor, who say they had come to the public sector intent on helping the country with what they had learned in their careers. Not only did they suffer from being vilified in the media, but the pair were named among Toro magazine's top 10 losers of 2006.

Rotor's friends got him contract work, but everywhere he and Tipple went, they were asked to explain how they ended up on the front page of the Globe.

"The allegations of wrongdoing and implications of unethical behaviour really preclude you from performing senior roles either as an executive or at a board level," said Tipple, 60, whose lawyer, Stephen Victor, simply Googled Tipple's name at the hearing to show his client had suffered. "So it was difficult in resuming the activities that I had been used to and wanted to continue to perform. It was devastating."

Quigley reflected the impact on Tipple when he awarded unprecedented damages (the previous high for labour board damages was less than $200,000). He was assigned $125,000 for psychological injury, $250,000 for loss of reputation and $700,000 for lost wages. The initial damages are for $1.35 million, including interest, but that will expand when the legal fees are added because the government refused to hand over documents.

Tipple claims he is flummoxed by what really happened. All he knows is that his story acts as a cautionary tale for anybody from the private sector who has the temerity to think he can change the way Ottawa works.

Crown debt, in English law, a debt due to the crown. By various statutes, the first dating from the reign of Henry VIII of England. (1541), the crown has priority for its debts before all other creditors.

At common law the crown always had a lien on the lands and goods of debtors by record, which could be enforced even when they had passed into the hands of other persons.

The difficulty of ascertaining whether lands were subject to a crown lien or not was often very great, and a remedy was provided by the Judgments Act 1839, and the Crown Suits Act Coronets of Viscounts and Barons 1865.

Now by the Land Charges Act 1900, no debt due to the crown operates as a charge on land until a writ of execution for the purpose of enforcing it has been registered under the Land Charges Registration and Searches Act 1888.

By the Act of 1541 specialty debts were put practically on the same footing as debts by record.
 
Simple contract debts due to the crown also become specialty debts, and the rights of the crown are enforced by a summary process called an extent.

In modern parlance the term encompasses the various charges and taxes made by the Government of the United Kingdom

A flamboyant lawyer best known for representing murderer Tracie Andrews has served a jail sentence for masterminding a multi-million Legal Aid fraud, it can be revealed today.

Solicitor Timothy Robinson, now 60, was convicted of conspiring to systematically defraud the Legal Aid system of huge sums of cash over a period of almost six years.

As well as being sentenced to seven years in jail, he was ordered to pay more than £1 million in compensation and costs.

Robinson, who lived in the exclusive village of Badgeworth, near Cheltenham, was found guilty of conspiracy to defraud at Bristol Crown Court in January 2001 following an eight-month trial.

He was released on parole in July after serving half his sentence.

Tracie Andrews was jailed for life for the murder of her fiance Lee Harvey in 1996. She claimed he was killed by a stranger in a road rage attack and even made tearful public appeals for help in tracing the killer.

A further 21 former employees at his Gloucestershire-based practice either pleaded guilty or were found guilty of the conspiracy in a total of five trials. Just five were acquitted and charges against two lie on the file.

The investigation into Robinson's, one of the largest of its kind, began more than 10 years ago in April 1993 and is thought to have cost several million pounds.

The Serious Fraud Office and three police forces took more than 3,000 witness statements and seized 21 tonnes of documents from the firm's offices as they investigated the scam.

The conspiracy involved employees at the firm, once regarded as one of the largest criminal defence practices in the country, claiming Legal Aid for millions of pounds' worth of work they did not do.

Details of the fraud could only be reported for the first time today after reporting restrictions, which had been put in place to avoid prejudicing future court proceedings, were lifted by a judge.

This happened after the charges against the remaining defendant, Archibald Ross, were ordered to lie on the file after medical evidence showed that the trial was unlikely ever to go ahead.

ALBERTA Finance Minister Iris Evans
Finance Minister Iris Evans told the legislature Tuesday that the value of the Heritage Fund has been reduced to $16 billion since June, a drop of roughly six per cent. But she's downplaying the loss.

"That's a paper loss, it does not translate into an immediate loss," Evans said in an interview after commenting publicly on the Heritage Fund losses for the first time.

"That's the worst-case scenario."

Economist Mike Percy said with declines of 30 to 35 per cent in both the Toronto and Dow stock exchanges, it's not surprising that Alberta's Heritage Fund is also showing a considerable paper loss.

A father trying in vain to find out how much he owed — the number changed every time he called and it impacted his credit rating — was finally told that he was behind $6,064. The ombudsman dug more deeply and discovered he had no arrears, and F had to admit they had overlooked a letter from the mum saying he was paid up.

One man told the ombudsman that he was "afraid" of his worker at the Office of the Public Guardian and Trustee, which steps in to oversee the care of frail and vulnerable people when they have nobody else to help them.

"The worker admitted this to Ombudsman staff, saying she yelled at the man and hung up because she didn't know what to say to him anymore," the report says.

22 February, 2011 McKee had been on parole at the time as a result of pleading guilty to lesser charges stemming from a failed IED bombing targeting the member of a rival racist gang known as Western European Bloodlines.
